Building a Global Engineering Firm’s Australian Workforce: From Market Entry to Permanent Residence
The challenge
Our client is the Australian arm of a globally certified engineering firm. Several years ago, the group decided to enter the Australian market. Establishing a foreign business here is not only a commercial and regulatory exercise. It is a workforce one. To win and deliver its projects, the business needed to bring specialised management, engineering and technical personnel into Australia, people with skills and group-specific experience that were not readily available in the local labour market, and to do so lawfully, quickly, and in a way that could scale with its project pipeline.
The challenge was to design an immigration framework from the ground up. That meant securing the right to sponsor overseas workers in the first place, moving key people into the country on the correct visas at the right time, building a pathway to permanence for the people the business most wanted to retain, and keeping the whole arrangement compliant and responsive as projects ramped up and down.
Our approach
We acted as the business’s immigration partner from the point of market entry and built the strategy in stages.
First, the strategy. Before any individual visa was lodged, we mapped the group’s Australian plans against the visa framework and set out an immigration and workforce strategy: which entity would sponsor, which roles would be filled by overseas personnel, on which visas, and over what timeframe.
Second, sponsorship. We applied for and obtained Standard Business Sponsorship (SBS) for the newly established Australian branch, the approval that allows a business to sponsor overseas workers. Securing this for a newly established entity, which does not yet have a trading history in Australia, calls for careful presentation of the business, its structure and its plans.
Third, mobilising key personnel. With sponsorship in place, we secured subclass 482 visas, now issued under the Skills in Demand framework, for key management, engineering and technical staff. This allowed the business to bring its people into Australia to establish and run its operations.
Fourth, permanence. As the business matured, we assisted some of its key personnel, including its Regional General Manager, to obtain permanent residence through the employer-sponsored pathway (subclass 186 Employer Nomination Scheme), helping the business retain the leadership and expertise it had invested in.
Fifth, ongoing support. We continue to act for the business. We secure subclass 400 visas (Short Stay Specialist visas) for specialist technical personnel to meet short-term project ramp-ups, and subclass 482 visas to fill longer-term roles, so the workforce can flex with project demand.
The outcome
What began as a market-entry project has become a long-term partnership. Our client established itself in the Australian market with a compliant sponsorship framework, moved its key people into the country on the right visas, and secured permanent residence for personnel central to its operations, including its Regional General Manager. The business continues to deploy specialised personnel into Australia as its projects require, supported by an immigration framework built to scale.
